What Can Pres. Noynoy Do about GAMCA

GAMCA or the Gulf Cooperation Council (GCC) Accredited Medical Clinics Association was reportedly initiated in Bangladesh as a result of the huge number of Bangladeshi workers being sent back home after undergoing medical checkup and found unfit to work in their host countries. Apparently, overseas recruitment and placement agencies in that South Asian country routinely negotiated with clinics to stamp workers “fit-to-work” even if the result of a medical examination is contrary, in exchange for “kickbacks” from the workers.

After the creation of GAMCA in 1999, medical exams were standardized and the number of cases of workers being sent home to Bangladesh due to medical checkup failures, dropped considerably. Hailing the effectiveness of the scheme, GCC countries – Bahrain, Kuwait, Oman, Qatar, Saudi Arabia and the United Arab Emirates – sought to emulate the system in India, the Philippines and other Asian countries.

In 2001, the Executive Board of the Health Ministers’ Council of the GCC established in the Philippines the centralized medical referral decking system, through GAMCA, “to address the proliferation of fake medical certificates, do away with the rebates that affect the integrity of medical testing, and to protect the citizens of GCC countries from being infected with communicable diseases that may be borne by GCC-bound OFWs.” Under this system, Filipinos who are applying for overseas employment in the Gulf States shall undergo medical examinations in GAMCA clinics only.

  10. Physicians Diagnostic Clinic
  11. Philippine Medical Test System
  12. Ruben Bartolome Medical Clinic
  13. S.M. Lazo Medical Clinic
  14. St. Martin Polyclinic
  15. St. Patrick’s Healthcare System
  16. St. Peter & Paul Medical Clinic
  17. St. Vincent Medical Clinic

There is no denying that GAMCA’s aim is noble. Yet, why is there so much complaints and opposition to its continued existence in the Philippines? Primarily, overseas Filipino workers (OFWs) feel that GAMCA’s standard for a fit and healthy worker is not only very strict, but is somewhat ridiculous. An OFW could be stamped as “unfit” to work in GCC countries if he has any of the following “diseases”:

Infectious category:

  • HIV/AIDS reactive
  • Hepatitis B surface antifgen, HCV reactive
  • Microfilaria positive and malaria blood film positive, known leprosy patients
  • Tuberculosis – any type, X-ray showing active PTB, past evidence of PTB or healed pulmonary scar, including minimum fibrosis, calcification (granuloma) pleural thickening, pleural effusion, tuberculosis lymphadenitis
  • VDRL/TPHA reactive
Non-infectious category:
  • Chronic renal failure
  • Chronic hepatitis failure
  • Congestive heart failure
  • Hypertension
  • Diabetes mellitus
  • Known case of cancer
  • Psychiatric disease and neurological disorders
  • Physical disabilities, i.e. color blindness, deafness

A large number of prospective and redeploying OFWs had been denied a chance of working abroad because of this unreasonable GAMCA standard. As emphasized in the list above, a past evidence of PTB or healed pulmonary scar is considered by GAMCA as an infectious disease. OFWs need not be medical specialists to know that a past evidence of PTB or healed pulmonary scar simply means that a person had already been cured of PTB, as evidenced by the healed scar. How could a scar – healed and dry – become a disease, much more an infectious one? This lamentable case is best illustrated by a GMA News.TV story of nurse “Sitti”:

Filipino nurse Sitti thought that she had finally fulfilled her dream of working in Saudi Arabia after passing a hiring firm’s standards, only to be denied that opportunity by a failed medical test administered by an exclusive group of clinics…

… In an e-mail sent to the Center for Migrant Advocacy, Sitti said that a Gamca clinic declared her “unfit” to be deployed because a scar was reportedly found on her lungs.Being a nurse herself, she said that she got a second opinion from the Lung Center of the Philippines and found out from the results that the scar was inactive and was told that this wouldn’t be a hindrance to her work.“Binigyan po ako ng clearance ng Lung Center stating na I am fit to work (I was given a clearance by theLung Center stating that I am fit to work),” she said in the e-mail.After being declared “unfit” by the Gamca clinic, however, she went back to Mindanao, bothered by the thought that if she applied again, she would still be turned down.

Another reason for GAMCA’s notoriety among OFWs and recruitment agencies is the perception that the association is exploiting the OFWs’ inherent vulnerability in seeking medical clearances and is “reportedly operating like a cartel or mafia”.

The “referral decking system” is a centralized medical referral decking system established in 2001 by GCC states — Saudi Arabia, Oman, Qatar, Kuwait, United Arab Emirates, and Bahrain supposedly to stop the proliferation of fake medical certificates and the transfer of communicable diseases from foreign workers to citizens of the GCC-member countries.However, some migrant groups have scored the Gamca for operating like a cartel or “mafia,” saying these clinics connive with each other to reap profit from charging exorbitant medical fees.“The recruitmentagency refers the aspiring OFW to Gamca, and Gamca in turn designates a member-clinic to conduct the medical checkup and formalities on an aspiring OFW only after the job seeker (has paid) hundreds of pesos for the ‘referral’ made by Gamca,” said John Leonard Monterona, Migrante regional coordinator for the Middle East in a recent statement.Monterona previously said that even those who are healthy would be surprised to find that their medical test results indicate that they have a spot on their lungs, or need to clean their teeth, or need to undergo electro-cardiograph (ECG) test.

A 2005 position paper submitted to the Department of Foreign Affairs (DFA) by the Filipino Migrant Workers Group raised the following very convincing points:

… Clinics have started charging PHP2600 to PHP2700 per Worker (Phase 1 & 2). Out of the PHP2600.00, the Clinics give an average of PHP1000 (to as high as PHP1400) to the Agency who refer their workers. This only means that the Clinics are still earning despite giving away almost half of the Medical Fee paid by the workers otherwise it cannot go on for more than a decade (1990-2003). It’s unimaginable that the scheme (actually it’s a SCAM!) went on for 13 long years without the knowledge of the people tasked to look at the welfare of the OFWs resulting into a multi-billion-peso loss that could had been used to improve the lives of the Workers. A Cerebral mind is not needed to have an idea of how this scheme is working to the detriment of the Workers. This year, the amount of Medical fee for OFWs bound for Korea is PHP1,320 pesos only, THE TESTS ARE EXACTLY THE SAME AS THE ONES CONDUCTED TO GCC BOUND OFW’S BY GAMCA MEMBERS. The only difference is that those Clinics are NON-GAMCA members and do not have a DECKING SYSTEM , however, they are accredited by DOH-POEA and most of them are members of AMCOW (Association of Medical Clinics for Overseas Workers)…

As claimed by GAMCA, the Decking System was conceptualized and imposed by the GCC Health Ministers to address the problem they encounter on fake/forged Medical test Certificates. Though there is some compelling reasons for the GCC to guard their interests, it was very clear however, that the DECKING SYSTEM may have been hatched by GAMCA to achieve the following;1.They want to distribute the volume of Workers equally to all members thus assuring everyone an equal share of the booty at any given time.2.With the scheme, the OFWs and the Agencies are now left without a choice as to which Clinic to choose, thus the Clinic can now afford to keep the rebate for themselves.

FACT 1

Those 17 Clinics who now called themselves GAMCA are the same Clinics accredited by the GCC Embassies since the beginning, therefore it is logical to think that they are also the ones responsible for the issuance of the faked/forged Medical Certificates. Some of them were in fact suspended by the Embassies at one time or another and threatened with revocation of their accreditation.

FACT 2

The Medical Decking System was conceptualized and proposed as early as 1999, a series of hearings between the Recruitment Agencies and GAMCA were held at the DOH premises presided by Atty. Lutero without the representation from the Workers. There was resistance from the Recruitment Association aware of the consequences of the scheme, however, it was declared by PASEI & OPAP that they are willing to forego the Rebates for as long as there would be no implementation of the Decking System. Meanwhile, despite the many attempts to implement, GAMCA failed to push through with it. In the 2nd Quarter of 2001 Administrative Order No. 5 was issued approving the implementation of the Decking System, just a few weeks before Secretary Dayrit assumed the office of the Secretary of Health. We can only assume that GAMCA took it as a good timing to have the approval from the Secretary without elaborating the defects of the System. In the pretext of protecting the interest of the receiving countries, GAMCA likewise has managed to get the support of the GCC Ambassadors.

FACT 3

Despite the removal of the rebate and the clamor to lower the cost of medical testing fee, GAMCA has even used the scheme to squeeze the workers dry by imposing a lot of additional tests to benefit other Health Practitioners associated with them. Workers are immediately declared unfit should their BP register at 130 over 90 on their Sphygmomanometer. Should the worker appeal the Tests Results, he will be sent for Cardiac clearance to a designated Clinic of their choice thus spending thousands of pesos unnecessarily. The same goes for simple Dermatological deficiencies, Dental & Optometric Cases. It is now common for Workers to spend over PHP3000. This DECKING SYSTEM has legitimized the abominable act of squeezing more sweat and blood of the hapless OFWs.What makes it worse, even OFW dependents like mothers and children are declared unfit if they are found to be pregnant or found to have Scar in their Lungs. Isn’t this the height of stupidity? These are mothers and children who are going overseas to reunite with their family and not to work.

On September 26, 2008 Department of Health (DOH) Secretary Francisco Duque III signed Memorandum No. 2008-0210 ordering clinics belonging to and identified with GAMCA to “forthwith stop, terminate, withdraw or otherwise end the insidious practice known as the referral decking system.” But up to this time, the order is basically ignored by GAMCA, which continues to implement the system because they have a pending appeal with the Office of the President for the revocation of the DOH Order.

Meanwhile, a large number of OFWs continue to be denied their rightful means of livelihood in GCC countries. Ang hinaing ng mga kabayang Pinoy na napagkaitan ng hanapbuhay dahil sa hindi matuwid na patakaran ng GAMCA ay matatagpuan dito. Pangulong Noynoy, kung tunay ngang ang iyong “boss” ay ang Sambayanang Pilipino, sana ay bigyan mo naman ng pansin ang kanilang hinaing at dalhin mo sa “tuwid na daan” ang GAMCA.

    I have been working abroad for many years now despite the fact that I have this pulmonary fibrosis but this December 2011 I was diagnosed as unfit by Peter Paul as unfit.
    Does this means that I can no longer work abroad?

    1. There is. If your employers in the GCC countries could issue a waiver for you, you can still work there. Your employment agency could help you on that matter. But if not, you could always apply in other countries. The GCC countries are not the only place for us, OFWs. We are everywhere. Cheers. :)

      You will not qualify to work abroad bcoz of the findings of Peter Paul of having Pulmo Fibrosis only in Saudi Arabia and Qatar . You may challenge the clinic result but it could be a long process and a little expensive , To have ur own
      peace of mind – go to the Lung Center Hospital and tell them of your case ,
      ask for a specialist that is connected with an accredited gcc/gamca centers
      you need to confirm if Peter Paul result is for real or its just their x ray machines and technicians not functioning well ! Then if should find your x ray result normal
      clear – approach the DOH so they can endorse you to the Peter Paul

      Or you can go either to St Vincent clinic or Bartolome clinic – 2 break away clinics of the GCC but whose fitness certs are being recognized at the Saudi Embassy , Manila

  2. ako rin po may karanasan sa cangco medical clinic sa makati yakal st. na membro ng gamca. january 10 2012 po ako nagpamedical at hanggang ngayong february 18 2012 wala pa pong resulta kung fit or unfit. samantalang ang sabi nila sakin noon eh 3 – 4 days lang my resulta na. apat na beses din po ako pinabalikbalik sa clinic. ang masaklap po eh sa baguio city pa po ako nakatira at wala po akong kilala sa maynila, at nagpamdedical na rin po ako d2 sa baguio at within 2 days nakuha ko po result na fit to work ako. hindi po daw nila hhonor yung result ko dito sa baguio dahil hindi daw sila membro ng gamca ayon sa cangco medical clinic. baon na rin po ako sa utang dahil sa pamasahe pabalik balik sa clinic nila. sana may maka basa po nito na pwedeng tumulong. share ko lang po ito para mapansin maraming salamat po

    1. Dapat may result na yun. 2 to 3 days nga lang ang result nun. Tawag-tawagan mo na lang sila at itanong mong mabuti kung kelan at bakit wala pa rin yung result ng medical mo. Dapat itanong mo rin sa agency mo, yung agency kasi ang magsasabi kung Fit or Unfit to work ka.

    2. parehas tayo ng pinagdaanan..ang layo din ng tirahan ko, sa zambales pa ako. then pinabalik-balik ako ng clinic. then me na meet akong taga pampanga at taga dagupan,ganun din daw sila, pinapinom ng gamot, pero di nman daw din sila nakaranas na ubuhin tulad ko para magkaroon ng ptb scar..iniisip ko tuloy na baka sinabi lang ng taga clinic yun para di na kami magpabalik-balik at ayusin na lang dahil sa malalayo kami at sayang ang pera sa pamasahe?

    Hi, dapat kasi ung agency mo dito sa Manila that should be doing the follow ups to Christian Cangco clinic for your medical results , then relay it to you .

    if none , you have this options – call up the Angelina Punzalan clinic and look for their Director Dr Punzalan who is actually the head of GCC/GAMCA here and tell
    your case , should you be going back to Manila again instead report to Punzalan clinic para mag sumbong , or you may have the option to use St. Vincent Clinic – a break away clinic of GCC/GAMCA but whose fitness certs are recognized at the Saudi Embassy , Manila

    Sana maging successfull ka overseas

    1. I was scheduled by my recruitment agency for a medical checkup via GAMCA Referral. But the medical center is not a member of GAMCA according to sources via web. I’ve asked my agency regarding the matter and they told me that the GAMCA Office was the one who scheduled me for a medical checkup in the medical center and they would not do so if the medical center was not a member of GAMCA itself. I wanted to validate if the medical center is indeed a member of GAMCA but no contact details can be found via web. And the agency seems like in line with the GAMCA Decking System and that they might be protecting what should not be known. If I woud be spending money for medicals I want it to be valid and truthful. Does anyone know any contact details for GAMCA or should I consult in Apostol-Punzalan Clinic where the director is? Suggestions anyone?

  5. galing ako ng singapore for 5 years,every year may x-ray kami..wala man lang kahit anong problema sa x-ray.. pero eto, ng papunta na ng Ksa, ayan, nagkaproblema na,dami na tuloy utang,.. : (

    ang malupit pa nyan, 3 mos na ang nakalipas at palagay ko mag-eexpire na naman ang nauna kong medical, so panibagong gastos na naman para sa medical..this time for sure, pupunta ako sa lung center para komunsulta bago bumalik sa clinic.
    problema ko lang kung hanggang kelan ang validity ng visa ko for Ksa since napirmahan ko na yun last Jan. pa..

    Isa rin ako sa biktima ng Phil. Medical Test System sa QC na pinagastos ako ng pinagastos sa kung ano anong test (gaya ng Trade Mill na nagkakahalaga ng 2,000 peso) inirefer ako sa isang doctor sa heart center at kakausapin ka lang sandali ay magbabayad ka na ng 500 peso tapus bigyan ka ng referal sa isang kilala niyang clinic na may trade mill na kung saan ka magbabayad ng 1,200 peso plus iba pang charges.Ito ay puera pa yon 2,600 pesos na sisingilin nila bago mag umpisa ng Medical Test.
    Ang masakit dito ay napunta rin sa walang magandang resulta kasi meron daw nakita na scar sa lungs xray result ko. Ang unang araw ng test ay tinapus na ang chest x ray ko at sa second day ay alam na na meron scar sa findings ng xray result. Kung ang patakaran nila at sa GAMCA ay di puede ang meron scar, dapat dina nila ako pina punta pa sa TRADE MILL TEST na wala naman kuenta. In short gumastos ako ng halos 6,000 peso sa PHIL MED. TESTING SYSTEM (kuno) na walang napakinabangan. Sumulat ako sa management nila ng formal letter na nagsasabi na kagagaling ko lang sa Middle east (3 years ako don) at umuwi lang ako dahil lilipat ako sa bago kong employer pero di man lang ako pinagbiyan. Nagpamedical ako sa kanila non June 2011 at pinabalikbalik nila ako hangang August 2011 tapus di rin nag bigay ng Fit to work na aking hinihingi upang makabalik at magtrabaho ulit dito sa Middle East.
    Muntik ng nawala ang chance ko na makabalik dito dahil sa tagal na naghintay ang employer ko. Mabuti na lang at pinadlhan ako ng EXPRESS VISA ang employer ko non December 2011 para makabalik na ako. Nagpa Medical ako ulit dito para ma process ang mga documents ko gaya ng Working Visa at Resident Card ko at awa ng dios ay FIT TO WORK ang result at wala naman findings na gaya ng sinasabi ng PMTS (Phil. Money Testing System).
    Bakit ang kapwa natin pilipino ang gusto pang humarang sa atin na kualipikado na magtrabaho sa labas ng ating bansang Pilipinas.bilang OFW.
    Salamat at sana mabigyan ng ating gobyerno ng action sa mga Medical Testing Center na nag sasamantala sa atin mga OFW.

    Ill be signing a contract this coming wednsday sa agency sana d ko ranasin yang ganyan.. 2006 nag pa medical din ako sa arguelles and na pending ako kac may scar daw ako sa lungs ni refer nila ako sa pulmonologist yun binig yan ako ng clearance after seeing a pulmonulogist..

    inquire lang po ako, ready for work abroad na po ako sa qatar,pending ako sa Xray (GAMCA accredited – Medisense Laboratory sa KALAW) dhil may spot daw, mag medicate daw ako ng 7days niresetahan ako ng antibiotic,after that bumalik ako ganun pa din daw medicate daw uli,so hindi na po ako nging comportable kasi hindi naman ako nagsisigarilyo at walang ibang bisyo, nagdecide po ako pamedical Xray sa Mega clinic(megamall) at Pinabasa ko rin xray sa lung center parehas ang findings nila normal “clear lungs” dinala ko po ito sa Laboratory(GAMCA accredited – Medisense Laboratory sa KALAW) pero hindi nila kinonsider..
    anu po magandang gawin ko kasi nahahadlangan nila yung mga tao gustong mag abroad at makahanap ng mas mataas na sweldo na hindi na sa tingin ko wala naman akong sakit at dapat (FIT TO WORK NA AKO) Kasi sa current employer ko dito pinas may annual medical kami lagi naman normal sa lahat..
    please help me po malaking tulong kung may mabibigay po kayo idea para ma solve problema ko at matupad pangarap ko..

      Nararapat lang na magkaisa ang mga Filipino para i-abolish na yang GAMCA na yan na nagtatanggal sa karapatan natin na kumita ng malaki sa ibang bansa na hndi naman kayang ibigay ng local companies dito sa atin…Responsibilidad ng gobyerno ng Pilipinas na bgyan ng proteksyon ang kanilang mamamayan ngunit sila pa ang pumapasok sa isang kasunduan sa ibang bansa katulad ng GAMCA na di naman makatuwiran ang mga GUIDELINES…
      SAMASAMA NATING TUTULAN ang GAMCA…ipaalam natin sa natutulog nating gobyerno ang sigaw ng mga manggagawang Pinoy na tutulan na ang GAMCA sa PILIPINAS upang magkaroon tayo ng pagkakataon na kumita sa ibang bansa na di natin kaylanman kikitain sa Pilipinas!

    Bikitima din ako ng “maling” diagnosis sa St. Peter Paul Medical Clinic. Based sa initial results ng Hepa B Surface Antigen (HBsAg) ko ay mababa naman. pero sinabihan ako ng doktor na mag take ng Silymarin at mag test after two weeks. Nagulat ako dahil biglang tumaas yung count at sinabihan na “NOT FIT TO WORK” ako dahil “Reactive” daw!. sinabihan ko sila na kukuha ako ng second opinion mula sa spesiyalista, pumayag naman ang doktor, pero nang sabihan ko ang agency ko (AU Management Services, Inc.) wag na daw dahil parehas lang ang result.

    Tinuloy ko parin ang retest at lumabas sa dalawa kong HBsAg na “Non-Reactive”. May dalawang additional test pa nga sa liver na sina ng Interminal Medicine Doc na nagpapatunay na wala talaga akong Hepa B, dahill wala din naman ako ng mga sintomas nito.

    Sinabi pa nga ng doktor na “..baka pineperahan ka lang..”.

    Kanino pa pwedeng mag file ng complaint sa mga maling diagnosis ng mga clinic na ito?

  19. Ako po nag aantay ng offer letter at referral for medical under GAMCA clinics. .Sa mga nababasa ko mukang hanggang ngayon may issue pa rin sa controversy ng GAMCA..Saan ba pwedeng mag pamedical na GAMCA clinic na hindi ka lulukohin sa result ng medical examination.?

  20. I was scheduled by my recruitment agency for a medical checkup via GAMCA Referral. But the medical center is not a member of GAMCA according to sources via web. I’ve asked my agency regarding the matter and they told me that the GAMCA Office was the one who scheduled me for a medical checkup in the medical center and they would not do so if the medical center was not a member of GAMCA itself. I wanted to validate if the medical center is indeed a member of GAMCA but no contact details can be found via web. And the agency seems like in line with the GAMCA Decking System and that they might be protecting what should not be known. If I woud be spending money for medicals I want it to be valid and truthful. Does anyone know any contact details for GAMCA or should I consult in Apostol-Punzalan Clinic where the director is? Suggestions anyone?

(actually re med nlng aq, kc na-expire ung una q med s San Marcelino dhil s paghihintay ng visa q n ndelay) Yung una q med s San Marcelino ay FIT TO WORK, now n nirequest aq s Gamca, cnabi q s agency n nabasa q n ang mga negative comments dto at sabi s kin n itry q p din dhil ito ang ibinigay s kin n clinic. so nung nag pa med n aq s Physicians bigla aq pinabalik for HEPA C! uulitin dw, at take note! d n aq pinagbayad p ulit! un pla after ilang araw–POSITIVE DW AQ S HEPA C!!!! cyempre nagrequest aq s agency ng 2nd opinion dhil alam q n healthy aq at wala aq record ng gnun! at re med nlng ito at nag fit to work aq dun s una q med, kaya pinapunta aq s SM LAZO CLINIC for 2nd opinion–at NEGATIVE ANG RESULT!!!! anong kalokohan ito!? kaya ang advice s kin ng Agency q kunin ang original result NEGATIVE s SM LAZO at ibigay s PHYSICIAN’s pra i-fit to work n aq, pro nagrequest p ulit ang Physician’s n itest ulit aq!?! ayaw maniwala?! so hihintayin q dw ang result by monday -MARCH 11, 2013! ang tip s kin ng doctor s SM Lazo, just incase n mag positive prin aq s kanila–humingi n aq ng advice o pumunta aq s DOH pra malaman if bkit aq nag popositive s Physicians!!! Pera pera lng yata tlaga!!! Nakakainis kung sino pa ang mismong kababayan ntin, sila pa ang nanloloko s tin!!!

  24. It’s shocking to read about these comments about sa GAMCA clinics na yan. Nagsign na ako ng offer letter from a reputed company in Qatar and nagmedical ako last March 7, 2013 sa Medisense (Kalaw), ang nakakagulat may findings sila na ”minimal apical pleural thickening” contradictory sa latest xray ko from Makati Medical Center last Feb. 27, 2013 na normal lungs, attested pa to ng pulmonologist ko from St. Lukes the Fort. What’s intriguing is in just a span of 1 week nagkaroon na ako agad ng findings na ganon? How come hindi lumabas yung findings na yun sa xray ko sa makati med? given na same view lang ang ginamit ? disclosed ko na purpose ko for the xray is for employment overseas ( Gulf countries)
    At bakit din hindi nakita ng pulmonologist ko yun? Do they mean na mas high quality ung xray process nila compared sa Makati med and St. Lukes? I know these 2 hospital are not GAMCA related but they are reputable health institution w/ valid and credible health services. Babalik uli ako dun and they better give me a good explanation sa mga findings nila 3x na ako pabalik2x sa medical clinic na yun.

    ano ba aksyon ng gobyerno tungkol jan sa mga medical clinics na mukhang pera na,walang awa pa! akala nila pinupulot lng natin ang pera? sa hirap ng buhay natin ngaun gusto mo man mag-abroad para makaraos..eh pinagloloko lang tau ng mga medical clinics kya mawawalan din tau ng pag-asa,,ang gobyerno wala man lang ginawa eh kung d dahil sa mga OFW’s ano kaya buhay ng pamahalaang pilipinas natin? wala talagang mga awa mga taong to!

    nagpamedical ako sa bartolome clinic at pending dahil sa inguilar hernia…advice ng doctor sa bartolome na magpaopera daw muna ako at bumalik sa kanila para gawing fit to work ang medical ko. teacher po ang inaaplayan ko at hindi naman field work. advise naman po kung ang dapat kung gawin kasi dapat makaalis ako before end ng june. salamat po
